1. Acceptance of Terms
By accessing and using StreetEat as a vendor, you accept and agree to be bound by the terms and provisions of this agreement.
2. Vendor Disclaimer
StreetEat is a platform that connects food vendors with customers. Please note the following important disclaimers:
- No Vetting Process: StreetEat does not conduct background checks, verify credentials, or vet vendors who use this platform. Vendors are solely responsible for their own business practices, food safety compliance, and legal obligations.
- No Endorsement: StreetEat does not personally endorse, recommend, or guarantee any vendor listed on the platform. Customers purchase from vendors at their own discretion and risk.
- Vendor Responsibility: As a vendor, you are entirely responsible for the quality, safety, and legality of your products and services. You must comply with all applicable local, state, and federal laws and regulations.
3. Software Provided "AS-IS"
The StreetEat platform and all associated software, features, and services are provided on an "AS-IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
StreetEat makes no warranties or representations about:
- The accuracy, reliability, or completeness of the platform
- Uninterrupted or error-free operation
- The results that may be obtained from using the service
- The correction of any errors or defects
4. Vendor Obligations
As a vendor on StreetEat, you agree to:
- Maintain all required business licenses and permits
- Comply with all food safety and health regulations
- Provide accurate information about your products and services
- Honor all orders and transactions made through the platform
- Maintain appropriate insurance coverage for your business
- Handle customer data responsibly and in compliance with privacy laws
4A. Business Verification (Optional)
Verification is Optional: StreetEat offers an optional business verification program where vendors may upload business licenses and food handler certifications. Participation is entirely voluntary and is not required to use the StreetEat platform.
Verification Does Not Guarantee Compliance: The "Verified Business" badge indicates only that a vendor has submitted documentation to StreetEat for review. StreetEat does NOT:
- Verify the authenticity of submitted documents
- Confirm current validity of licenses or certifications
- Inspect food preparation facilities or practices
- Monitor ongoing compliance with food safety regulations
- Guarantee the safety, quality, or legality of vendor operations
Vendor Sole Responsibility: You, as the vendor, are solely responsible for:
- Obtaining and maintaining all required business licenses, permits, and certifications
- Complying with all applicable federal, state, and local food safety regulations
- Ensuring the safety and quality of all food products and services
- Maintaining current and valid documentation at all times
- Updating or removing verification documents when they expire or become invalid
Customer Responsibility: Customers should independently verify vendor licenses and food safety compliance. StreetEat is not liable for any food safety issues, health concerns, or regulatory violations related to vendor operations, whether verified or unverified.
Verification May Be Revoked: StreetEat reserves the right to revoke verification status at any time, for any reason, including but not limited to: expired documents, customer complaints, regulatory violations, or fraudulent submissions.
4B. Allergen Information (Optional)
Allergen Information is Optional and Vendor-Provided: StreetEat offers an optional feature allowing vendors to provide allergen information for their menu items, including common allergens (milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy), custom allergen warnings, and cross-contamination notices.
StreetEat Does NOT Verify Allergen Information: All allergen information displayed on the platform is provided solely by vendors. StreetEat does NOT:
- Verify the accuracy or completeness of allergen information
- Inspect food preparation processes or ingredients
- Test food products for allergen content
- Monitor changes in recipes or ingredients
- Guarantee the safety of any food products for individuals with allergies
Vendor Sole Responsibility for Allergen Accuracy: You, as the vendor, are solely and exclusively responsible for:
- Providing accurate and complete allergen information for all menu items
- Updating allergen information immediately when recipes or ingredients change
- Implementing proper food handling practices to prevent cross-contamination
- Training staff on allergen awareness and safe food preparation
- Disclosing all potential allergen risks, including cross-contamination in your facility
- Complying with all applicable federal, state, and local allergen labeling laws and regulations
Customer Responsibility: Customers with food allergies or dietary restrictions must:
- Independently verify allergen information directly with vendors before ordering
- Not rely solely on allergen information displayed in the StreetEat app
- Inform vendors of allergies and ask questions about ingredients and preparation methods
- Understand that StreetEat is not liable for allergic reactions or foodborne illnesses
Disclaimer of Liability: StreetEat expressly disclaims any and all liability for allergic reactions, foodborne illnesses, health complications, or any injuries arising from reliance on allergen information provided by vendors. By providing allergen information, you acknowledge and agree that StreetEat is merely hosting this vendor-provided data and bears no responsibility for its accuracy or completeness.
5. Limitation of Liability
StreetEat shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use or inability to use the platform
- Any transactions between vendors and customers
- Unauthorized access to your account or data
- Any errors, viruses, or other harmful components
- Customer complaints or disputes
- Food safety issues, health concerns, or injuries related to vendor products or services
- Reliance on business verification status or submitted documentation
- Allergic reactions, foodborne illnesses, or health complications arising from vendor-provided allergen information
- Inaccurate, incomplete, or outdated allergen information provided by vendors
6. Indemnification
You agree to indemnify and hold harmless StreetEat, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the platform
- Your violation of these terms
- Your violation of any law or regulation, including food safety, health, and business licensing laws
- Any products or services you provide to customers
- Any disputes with customers
- Food safety issues, foodborne illnesses, allergic reactions, or health concerns related to your products or services
- Any inaccurate, false, or misleading information you provide, including in verification documents
- Failure to maintain current and valid business licenses, permits, or certifications
- Inaccurate, incomplete, or outdated allergen information provided by you
- Failure to disclose allergens, update allergen information when recipes change, or prevent cross-contamination
- Allergic reactions, health complications, or injuries resulting from reliance on your allergen information
7. Account Termination
StreetEat reserves the right to suspend or terminate your vendor account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these terms
- Fraudulent or illegal activity
- Customer complaints or poor ratings
- Failure to comply with applicable laws
8. Subscription and Fees
Vendor subscriptions are billed monthly and will automatically renew unless canceled. You may cancel your subscription at any time through your account settings. Refunds are not provided for partial months of service.
9. Modifications to Terms
StreetEat reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the modified terms.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which StreetEat operates, without regard to its conflict of law provisions.
